The Court held that the notice provision requiring advertising in the legal organ of the county, meant to protect general citizens and businesses, such as the Oasis, was satisfied. The Court held Oasis did not have standing to pursue that claim as the particular notice provision was meant to protect the local government. Oasis argued the legislation annexing its property into the City of Doraville was invalid because the notice provision in state law requiring direct notice to the city was not satisfied. The trial court granted the City of Doraville's motion for judgment on the pleadings and Oasis appealed to the Supreme Court on constitutional grounds. In January the city denied the alcohol application from Oasis. Oasis applied for an alcohol license in December 2012 and filed a complaint against the city and its elected officials challenging the city code. On October 1, 2012, Doraville established an adult entertainment ordinance which prohibited fully nudity and sales of alcohol in adult entertainment establishments. In 2012 the Georgia General Assembly enacted legislation annexing the Oasis property into the City of Doraville effective December 31, 2012. Oasis had been located in the unincorporated portion of DeKalb County since 1990 and beginning in 2001 had "adult nonconforming status" with the county, which allowed the business to sell alcohol and provide nude dancing. The Supreme Court of Georgia held that an adult entertainment establishment, the Oasis Goodtime Emporium (Oasis), was properly subject to the City of Doraville's code and regulations that prohibited full nudity and sales of alcohol in adult entertainment establishments.
